Release of liability and assumption of risk
Please read this carefully. It affects your legal rights. By signing it you give up your right to sue Broward Strength & Performance for injuries, including injuries caused by its negligence.
In this waiver, "the Gym" means Broward Strength & Performance, 4860 S State Road 7 Suite A, Davie, Florida. "Released Parties" means the Gym and its owners, coaches, employees, contractors, agents and landlord. "I" and "me" mean the person signing.
1. The activities
I want to use the Gym's facility and equipment and take part in its training, classes, coaching (in person and online), nutrition coaching, open gym, competitions and events (together, "the Activities"). The Activities include lifting heavy weights, powerlifting, strongman, Olympic lifting, conditioning and other hard exercise, using barbells, dumbbells, machines, stones, yokes, sleds and other equipment, sometimes without a coach or spotter there.
2. The risks
I understand the Activities are dangerous and can cause serious injury, including muscle, tendon and ligament tears, back and joint injuries, broken bones, concussion, heat illness, heart attack, stroke, paralysis and death. Injuries can come from my own actions, from other members and guests, from dropped or falling weights, from equipment that breaks or fails, from the condition of the facility, from the coaching, programming or advice I get, and from the negligence of the Released Parties. Not every risk can be foreseen or removed.
3. I accept the risks
I take part voluntarily. I knowingly accept all of these risks, known and unknown, and I take full responsibility for any injury, illness, death, loss or damage that results.
4. My health
I am healthy enough to take part. I will check with a doctor before I start if I have a heart, lung, blood pressure, joint, back or other medical condition, if I am pregnant, or if I'm not sure. I will tell a coach about any condition or injury that could affect my training, train within my limits, and stop if I feel pain, dizziness, faintness or shortness of breath. The Gym's coaches are not doctors, and nothing they tell me about training or nutrition is medical advice.
5. Release and promise not to sue
To the fullest extent the law allows, I release, waive and discharge the Released Parties from, and agree not to sue them for, any and all claims, demands and causes of action for injury, illness, death, or loss of or damage to property, arising out of or related to the Activities or my being at the Gym, INCLUDING CLAIMS CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES. This release does not cover gross negligence or intentional misconduct.
6. Indemnity
I will defend, indemnify and hold harmless the Released Parties from any claims, costs and attorney's fees that arise from my participation in the Activities or my conduct at the Gym, including claims brought by my family or my estate.
7. Rules
I will follow the Gym's rules and its staff's instructions, use collars, safeties and spotters when it makes sense, keep the floor clear and put equipment back. The Gym can remove me if I train unsafely or break the rules.
8. Medical care
If I'm hurt or become ill, I authorize the Gym to get emergency medical care for me. I am responsible for the cost of any treatment.
9. Personal property
The Gym isn't responsible for anything lost, stolen or damaged on its premises.
10. The rest
This waiver covers every visit and every membership, now and in the future. It is governed by Florida law, and any dispute will be heard in Broward County, Florida. If any part of it is found unenforceable, the rest still applies. I have read it and understand it, I am at least 18 years old, and I am signing it freely. My electronic signature counts the same as a handwritten one.
